razer is breaking the law, what do i do?


So I have bought the headset Razer kraken V3 pro 3 years ago. They broke around year ago. In polish consumer law it is said, that if a warrantor exchanges an item for new one, the warranty is refreshed anew. I'm from Poland and I bought it in Poland. 

I was in contact with "vip" Razer team, but they just say they do not care about polish consumer law, they just act as if it does not exist and just say due to warranty regulations they have and the entry that the warranty is up to two years nothing can be done. But there are entries in it that say, that consumer law from the buyers country are also valid I said. THEY DO NOT CARE. Beware, they have law for nothing.

If anyone wants to check polish law about it, it is article 581 of civil code.

I do not have a court case yet. 

It is sad, because the court case will cost a lot more than the headset itself, because if I sue Razer.Inc, then even if we get a good outcome, then they do not have to do anything since they’re based in USA. And if I sue Razer EUROPE GMBH, they might just say that they are not a warrantor so they’re not a side.

This is ridiculous lol.

I know it’s silly, but if you bought it at some local shop, then why you don’t RMA it locally?

Because local shop is not a warrantor. They can only take care of it after first 2 years after purchase. In this case, I can demand something only from warrantor.

Local shop should handle it to their distributor. But they’re lazy to do it.

In PL there’s another way to handle warranty (called “rękojmia” - dunno if there’s english equivalent for this) - it’s a shop warranty (not a producer warranty), and in most times it’s better to return it in this way, but it’s also 2 years or “warranty”.

So basically if you bought it 3 years ago you don’t have any warranty (nor producer or the seller warranty). Or you had your headset replaced on warranty before, because I don’t get this?

hey,

Yes, it was replaced around a year ago by Razer. Hence why the warranty period should start anew since then, but razer claims otherwise sadly. 

So I still should have around a year of warranty left...

Ok, that makes sense now. 

But if it was replaced by Razer USA for eg. it may not extend the warranty for new replaced product (unless the warranty conditions state otherwise).

That's why IMO it’s the best to always use seller warranty if possible.

It is not the case, the local consumer law allways take priority. I even asked their direct competitors which are also  not stationed in Poland, and their answer was that they renew the warranty if they exchange an item.

I could use “rękojmia” but at the time it did not make sense lol.

Additionally, there is this entry in razer warranty regulations: “This Limited Warranty gives you specific legal rights, and you may have other rights that vary by your country, province or state, as applicable.”

Which proves what I mentioned above. They just do not care since even if someone will sue them for that, then next 20 ppl will not.
